Banjul Protocol on Marks now effective in The Gambia

African Regional Intellectual Property Organisation (ARIPO) is mandated to register marks and the administration of such registered marks on behalf of the Banjul Protocol Contracting States in accordance with the provisions of the Banjul Protocol on Marks. The Banjul Protocol on Marks was adopted on November 19, 1993, at Banjul, The Gambia.

As of 2/8/2021 it was 11 ARIPO contracting states from which you could apply to register a trademark through ARIPO. Those countries are Botswana, Kingdom of Eswatini, Kingdom of Lesotho, Liberia, Malawi, Mozambique, Namibia, Sao Tome and Principe, Tanzania, Uganda, and Zimbabwe.

The Government of the Republic of the Gambia deposited its Instrument of Ratification to the Banjul Protocol on Marks with the Director General of ARIPO on 3 May 2021. On 3 August 2021, the Banjul Protocol become effective in The Gambia, making it the 12th contracting State of the Banjul Protocol. Now if you have trade or service mark which you have applied to register or have registered in your country or another country and want to claim the benefits of the earlier application and its registration date in Gambia, you can do it through ARIPO. The process is simple.

The application for the registration of a trade or service marks of this nature are made in the same manner as is required in the case of any ordinary application subject to any other requirements which may be prescribed.
